Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Sticky Notes Widget application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Sticky Notes Widget is a note-taking application designed for iPhone, iPad, Mac, Apple Watch, and Apple Vision Pro. The App allows you to create, organize, and sync notes across your Apple devices using iCloud.

3. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable law or regulation
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the App or servers connected to the App
• Use the App to transmit any malicious code or harmful content

4. In-App Purchases and Subscriptions

The App may offer in-app purchases and subscriptions through Apple's App Store. All purchases are processed by Apple Inc. and are subject to Apple's terms and conditions. We use RevenueCat to manage subscriptions and in-app purchases.

By making an in-app purchase, you agree to:

• Pay all charges associated with your purchase
• Comply with Apple's payment terms
• Understand that all sales are final unless required by law

Subscriptions will automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage your subscriptions through your Apple ID account settings.

5. Data Storage and iCloud

Your notes and data are stored using Apple iCloud. By using the App, you acknowledge that:

• Data storage and synchronization are provided by Apple iCloud
• You are responsible for maintaining your Apple ID and iCloud account
• We do not have access to your notes or personal data stored in iCloud
• Apple's iCloud terms and conditions apply to data storage

6. Third-Party Services

The App uses the following third-party services:

• RevenueCat: For managing in-app purchases and subscriptions
• Firebase Crashlytics: For collecting crash reports to improve app stability
• Amplitude: For analytics to understand app usage and improve user experience
• Apple Services: For in-app purchases, iCloud storage, and device integration

Your use of these services is subject to their respective terms of service and privacy policies.

7. Intellectual Property

The App, including its design, features, and content, is owned by KK FAMILY SOFTWARE LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the App without our express written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KK FAMILY SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KK FAMILY SOFTWARE LLC operates, without regard to its conflict of law provisions.
